Can i take my ex husband back to court to get back custody of our kids ?
we modify the papers and i gave him sole custody of the kids with me with reasonable visitations he does not let them see me hardly at all now that he is remarried.Can i take him back to court and file for my custody back to our children we live in alabama
You can certainly try.
First of all, was what considered “reasonable visitation” outlined in your court order? If it said something specific, such as “visitation every other weekend” or something along those lines, then he can be in violation of your court agreement. If it just said reasonable, then you’re not going to get very far, since it’s left up to him to determine what he thinks is reasonable.
To be blunt, you gave him sole custody. It’ll be pretty hard to convince the courts that now you suddenly want custody again, after you already gave up that right. You can try, but you might make him angry, and he might give you even less visitation after that. Also, I see in your past questions that you have a history of drug usage. Sorry, but you are really not a good candidate to fight for custody. You gave up that right already. On top of it, what court would give it back to you, considering your history of drug usage? There is a stable two-parent household without a documented history of drug usage, so why exactly would they give you custody instead? I can’t think of any good reasons whatsoever.
